1. Agreement to these terms

These terms form an agreement between you and CastNest governing your use of the CastNest platform. By creating an account or using the service you accept them. If you are agreeing on behalf of an organization, you confirm you have authority to bind it.

2. Your account

You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity that takes place under your account. Tell us promptly if you believe your account has been compromised.

You must be at least 18 years old, or the age of majority where you live, to hold an account.

3. Acceptable use

You agree not to use CastNest to stream, host or distribute content that:

• Infringes the copyright, trademark or other rights of any third party, including music you are not licensed to broadcast.
• Is unlawful, defamatory, harassing, or incites violence or hatred.
• Depicts child sexual abuse material, or non-consensual intimate imagery.
• Contains malware, or is used to attack, overload or gain unauthorized access to any system.
• Violates sanctions, export controls or other applicable law.

4. Content ownership

You retain all ownership of the video and other content you upload or broadcast. You grant us a limited license to host, transcode, cache, transmit and display that content solely to operate the service on your behalf.

You are responsible for holding all rights and licenses necessary for the content you broadcast, including performance and streaming rights for any music.

5. Plans, billing and renewal

Plans are billed in advance on a monthly or annual cycle and renew automatically until canceled. Prices are stated in US dollars and exclude any taxes that may apply. Annual billing is discounted against the equivalent monthly rate.

You can cancel at any time from your account, and the cancellation takes effect at the end of the current billing period. Upgrades take effect immediately with the remaining balance prorated; downgrades take effect at the start of the next period.

Where usage exceeds the player bandwidth, storage or stream slot allowance included in your plan, we will contact you to move to a suitable plan. Additional usage may be charged at the rates published at the time.

6. Free trial

Selected plans include a free trial of the length stated at sign-up. A trial is available once per account, is provided as-is, and may be withdrawn or adjusted with reasonable notice. Accounts created to obtain repeated trials may be suspended.

7. Service availability

We work to keep the service available continuously, but we do not guarantee uninterrupted operation on published plans. Planned maintenance is notified in advance where practical. Contractual uptime commitments can be arranged under a separate written agreement.

8. Suspension and termination

We may suspend or terminate an account that breaches these terms, that is used unlawfully, or where non-payment continues after notice. Where circumstances allow, we will give you notice and an opportunity to put things right first.

On termination you may export your content for a reasonable period, after which it may be permanently deleted.

9. Third-party platforms

Multistreaming sends your content to platforms operated by third parties, each with its own terms and content policies. We are not responsible for their decisions, including removal of your content or suspension of your accounts with them.

10. Disclaimers and liability

Except as expressly stated, the service is provided without warranties of any kind to the fullest extent permitted by law.

To the extent permitted by law, our aggregate liability arising out of or relating to the service is limited to the fees you paid us in the twelve months preceding the claim. Nothing in these terms excludes liability that cannot lawfully be excluded.

11. Changes to the service and these terms

We may modify the service and these terms over time. Material changes will be notified to account holders by email or in the dashboard before they take effect. Continuing to use the service after that point constitutes acceptance.
